Emma undertakes advocacy and provides advice in a broad range of legal matters:

  • Planning, environment, and government related matters for both merits hearings and judicial reviews;
  • Associated disciplines such as negligence, nuisance, trespass, water, contamination, environment impact assessment, extractive industry, vegetation, forestry, heritage, land valuation, property, rates and owners corporations;
  • Criminal matters relating to environment or regulatory type prosecutions; and
  • Court or Tribunal civil or public law matters including in relation to procedure and freedom of information.


Emma accepts briefs both as a junior and unled, and practices in the Court of Appeal, the Supreme Court, the County Court, the Magistrates’ Court, the Victorian Civil and Administrative Tribunal (VCAT), Planning Panels and a range of Advisory Committees and Inquiries.

Emma’s clients include:

  • Public clients – the Minister for Planning, State Government Departments, Local Governments, and Statutory Authorities such as Water Authorities, the Victorian Planning Authority and the Environment Protection Authority; and
  • Private clients – proponents as well as individuals, community and public interest groups.


Notable cases include:

  • The Brookland Greens Estate/Casey Landfill class action in the Supreme Court of Victoria, involving negligence and nuisance claims in relation to statutory authorities as well as contractual claims, and various interlocutory disputes in relation to pleadings, discovery and privilege (led by Albert Monichino QC);
  • Inquiries, Advisory Committees and Planning Panels including the:
  • Hazelwood Mine Fire Inquiry (Rehabilitation Terms of Reference) (led by Lisa Nichols); and
  • Melbourne Metro Rail Project Environment Effects Statement Inquiry and Advisory Committee (led by Adrian Finanzio SC); and
  • Administrative law appeals to the Supreme Court/Court of Appeal in relation to VCAT, planning, environment, and water law matters including:

Emma also provides legal and strategic advice in relation to the Planning and Environment Act 1987, Environment Protection Act 1970, Local Government Act 1989, Water Act 1989, Environment Protection and Biodiversity Conservation Act 1999, the Victorian Civil and Administrative Tribunal Act 1998 and related Acts (both unled, and led by Jeremy Gobbo QC and Paul Connor QC, amongst others).  

Prior to coming to the Bar, Emma was:

  • Associate to Justice Morris, then President of VCAT;
  • Associate to Justice Byrne, then Principal Justice of the Commercial and Equity Division at the Supreme Court of Victoria; and
  • Associate to Justice Osborn, then Head of the Valuation, Compensation and Planning List at the Supreme Court of Victoria.


Emma has also:

  • Worked as a solicitor and community legal education project manager at a Victorian environmental legal centre;  Volunteered for an environmental legal organisation in Myanmar in 2017;
  • Worked at an environment organisation in Vanuatu in 2009-2010, also attending the 2009 international climate change negotiations in Copenhagen.  Emma speaks fluent Bislama (pidgin English); and
  • Interned at the Environment Defenders Office Northern Territory.


Emma is a current member of the Victorian Bar’s Climate Change and Environmental Law Panel, the Victorian Planning and Environment Law Association, and the Women Barristers Association.  Emma is a past member of the Victorian Bar Council. 

Emma enjoys teaching advocacy, lecturing in environmental law, and presenting workshops on a variety of topics.
