Prior to coming to the Bar, Fiona Todd was a Senior Associate with Robert Stary Lawyers. She spent four years with that office appearing regularly as defence counsel in contested Magistrates’ Court proceedings (contests, committals and bail), County Court appeals and pleas, and Supreme Court applications.

While a solicitor Fiona had carriage of a range of defence cases in state and federal jurisdictions. Fiona conducted defence cases in large Commonwealth prosecutions for terrorism offences and people smuggling: R v  Benbrika  & Ors (Ruling No 20) [2008] VSC 80, R v  Vinayagamoorthy  & Ors [2010] VSC 148. She has written and presented papers on the litigation of prison conditions in R v Benbrika & Ors, a prosecution under commonwealth anti-terrorism law.

Since joining the bar in November 2011, Fiona has continued to build a successful practice as a defence advocate.  She is a Victoria Legal Aid Criminal Trial preferred barrister and holds a Victorian Bar Indictable Crime Certificate.

Fiona has appeared as sole counsel in conviction and sentence appeals in the Court of Appeal (see for example Mausii v The Queen [2012] VSCA 223, Johnston v The Queen [2013] VSCA 362, Wong v The Queen [2013] VSCA 52 and Gavanas and Khodr v The Queen [2013] VSCA 178.)  

She has also appeared as sole counsel and as junior counsel on applications and for Judicial Review in the Supreme Court: DPP v Leach & Anor [2012] VSC 96, YG v Chief Examiner [2012] VSC 385, and in the Court of Appeal: The Chief Examiner v Brown (a pseudonym) [2013] VSCA 167.   She has also appeared on applications for bail in the Supreme Court: Re Mitchell [2013] VSC 59.  She has also appeared as sole counsel in trials in the County Court.

Fiona has appeared as junior counsel in the High Court, in the Court of Appeal and in trials in the County Court: Calvert v The Queen [2012] VSCA 191, Barbaro v The Queen; Zirilli v The Queen [2012] VSCA 288. she has appeared as sole counsel in Crimes (Mental Impairment and Unfitness to be Tried) Act investigations and special hearings and appeared for the respondent in applications under the Serious Sex Offenders (Detention and Supervision) Act.

Fiona has also appeared regularly in contested proceedings in the Magistrates’ Court and at hearings of the Mental Health Review Board.

Fiona was previously Associate to Justice Morris of the Supreme Court and President of VCAT.
