PROFILE

Nicole accepts briefs to appear and advise in a wide range of commercial matters, with a focus on insolvency, Corporations Act matters, contractual disputes, class actions, equity and ACL claims.

Corporations Act and Interlocutory Matters

Nicole has a busy civil interlocutory practice, particularly in Corporations Act applications in the Supreme Court of Victoria and Federal Court of Australia. She regularly appears in applications to set aside statutory demands and has appeared in winding up proceedings, company reinstatement applications and in matters brought by or against insolvency practitioners. She has also acted in voidable transaction proceedings and conducted examinations for liquidators and receivers.

Bankruptcy Matters

Nicole has appeared on various bankruptcy related proceedings in the Federal Circuit and Federal Court of Australia, including:

  • defending applications to set aside sequestration order;
  • obtaining freezing orders on behalf of trustee in bankruptcy; and
  • contested creditor petitions

Commercial Litigation

Nicole is regularly briefed in a broad range of commercial litigation matters, both led and unled, primarily in the Supreme Court of Victoria, County Court of Victoria and Federal Court of Australia.

Prior to coming to the bar, Nicole spent many years practising in NSW, where she was the partner of a boutique law firm. Nicole managed an extensive range of commercial litigation disputes in the Supreme and Federal Courts and insolvency/restructuring matters. Nicole was recognised in Doyle’s Guide as a leading or recommended individual in NSW (insolvency) (2019 and previous years). 

Nicole read with Carl Moller SC and her senior mentor is Wendy Harris QC.
