Robert A Niemann is an experienced tax barrister having joined at the Victorian Bar since 2003.

His has widespread experience in managing collection disputes, including acting for taxpayers dealing with issues of insolvency and also disputed liabilities facing collection proceedings. 

This work includes written submissions and presentations to the Australian Taxation Office and the State Revenue Office and appearances at collection and bankruptcy pre trial hearings, hearings and trials.

He also has experience in defending positions in audits and against amended assessments, with wide experience in particular with challenging fraud and evasion determinations.  This work has extended to challenges of the Commissioner's conduct based want of jurisdiction and jurisdictional error.

Recent matters have involved disputes regarding to the operation of the personal services income provisions and default assessments based on claims or inferences of money laundering.

Robert also has extensive history and experience with the law of state duty and of trusts.

Robert is well versed in providing commercial corporate reconstruction and mergers and acquisitions taxation advice having worked in the tax groups at Arthur Robinson & Hedderwicks in Melbourne (now Allens) and Arthur Anderson (now Ernst & Young).

Robert has advised on the establishment, reconstruction and operation public offer of superannuation funds, self-managed funds and managed investment funds.  This has exended to advice and appearances in regulatory and taxation disputes and also dsiputes between parties.     

He was the author of the chapters on superannuation published in the Laws of Australia and has been a lecturer in tax and accounting at Monash University.

He also has acted and appeared for builders in regulatory disputes and claimed defects in their construction works.

Robert holds a Bachelor of Laws and a Bacherlor of Jurisprudence, with an accounting major, from Monash University.  He was the recipient of the Supreme Court Exhibition for his Jurisprudence Degree.
