PROFILE

Lachlan accepts briefs to appear and advise in a range of commercial law matters, with a focus on insolvency, corporations law matters, contractual disputes, equity and trusts. 

Since coming to the Bar, Lachlan has regularly appeared in State and Federal Courts in a range of commercial matters. Significant matters in which Lachlan has been briefed include:

  • Banksia Securities Limited v The Trust Company S CI 2015 01384

Prior to coming to the Bar, Lachlan was a solicitor at Arnold Bloch Leibler and a Senior Associate to two Judges of the Supreme Court of Victoria.

While at Arnold Bloch Leibler, Lachlan worked on a wide range of complex litigation involving corporations law matters, contract and trust disputes, insolvency, competition law and white-collar crime.

As the Senior Associate to the Hon. Justice Ferguson (now Chief Justice of Victoria), Lachlan supported her Honour with the management of the Corporations List in the Commercial Court and later in the Court of Appeal. 

Lachlan also accepts briefs in criminal matters. As the Senior Associate to the Hon. Justice Croucher, Lachlan assisted his Honour with criminal trials for indictable offences including murder, terrorism related offending and obtaining financial advantage by deception. He has a particular interest in proceeds of crime, confiscation law and commercial crime, including criminal cartel prosecutions, civil penalty and other proceedings arising out of investigations conducted by ASIC, the ATO, the ACCC and the Victorian Building Authority 

Significant criminal matters in which Lachlan has appeared since coming to the Bar include:

  • Hancock v R [2017] VSCA 239 (led by Scott Johns QC)
  • DPP v Semso Kraisnik S CI 2017 01725 – Confiscation Act application (unled).
  • CDPP v Simone Semmens CR-16-01616

Lachlan has also appeared in numerous interpleader applications in relation to seized property under the Victoria Police Act 2013.

Lachlan read with two mentors: Hamish Redd, who specialises in commercial law, and Scott Johns QC (now his Honour Judge Johns of the County Court) , who specialises in criminal law.  His senior mentor is Wendy Harris QC.
