Kay Chan

Kay has a broad practice in commercial, public and regulatory law.  She also practises in some areas of common law and accepts briefs in personal injury matters.  Since coming to the Bar, she has appeared in the High Court of Australia, the Federal Court of Australia and in State Supreme Courts and Tribunals.  She is regularly briefed to advise government and private clients.

• Matters concerning environmental regulation under the general environmental duty
• Judicial review by the Tasmanian Conservation Trust, successfully preventing the clearing of native forest 
• Thorpe v Head, Transport for Victoria — challenge to the Western Highway Duplication Project (opposing leave to bring derivative proceeding)
• Federal and State taxation proceedings
• Counsel for the Chief Commissioner of Police in applications for rulings on public interest immunity 
• Consultant Counsel to the Board of Inquiry into the COVID-19 Hotel Quarantine Inquiry, the Inquiry into the 2022 Flood Event in Victoria and Yoorrook Justice Commission
• Various NDIA matters in the AAT
• Appeals, interlocutory applications, judicial review proceedings and Charter-related litigation.
   

Before coming to the Bar, Kay was a Senior Solicitor at the Victorian Government Solicitor’s Office (VGSO) in the government and public law branch, specialising in regulatory, administrative and disciplinary law, and commissions and inquiries.  

Kay has also worked at the State Revenue Office where she conducted civil litigation from tribunal to appellate level.  Since coming to the Bar she has regularly advised taxpayers on issues of revenue law and objection and review rights.  

Kay holds a Bachelor of Laws (Hons) and Bachelor of Arts from Monash University.
