Some key concepts in the Evidence Act 2008 for civil practitioners

With the introduction of the Evidence Act 2008 (the Act), for the first time the differences in the rules of evidence relating to criminal and civil proceedings were clearly delineated. Nevertheless, the majority of sections apply to both criminal and civil proceedings with some additional protections for criminal proceedings.
