This paper looks at an injured person’s right to sue for damages when injury occurs in a sporting context. In particular, when does the defence of “voluntary assumption of risk” answer the claim? In examining that question, the authors refer to a few cases that illustrate the issues as they arise in practice. The cases are not the “leading cases” that have formulated the law, they are illustrations of the law in operation in a few instances of sporting injury.
