Jonathan Bayly

Jon's practice focuses on public law and torts. Since coming to the Bar, he has acted in:

• Judicial review proceedings in the Federal Circuit Court.
• Appeals from the Federal Circuit Court to the Federal Court.
• Judicial review and appeal proceedings in the Supreme Court of Victoria.
• Appeals from the Trial Division of the Supreme Court of Victoria to the Court of Appeal.
• A range of interlocutoryapplications in the Supreme Court of Victoria and the Federal Circuit Court.
• Applications under the Crimes (Mental Impairment and Unfitness to be Tried) Act 1997 (Vic).
• A range of meritsreview proceedings and interlocutory applications in the Victorian Civil and Administrative Tribunal.
• Professional disciplinary proceedings.

Jon also provides detailed advice to government and private clients on complex matters involving administrative law, constitutional law, statutory interpretation and torts (including negligence, defamation, assault, battery and false imprisonment).

Before coming to the Bar, Jon was a solicitor for over a decade. Between 2008 and 2016, he worked at the Victorian Government Solicitor’s Office, where he was a Principal Solicitor and chair of the VGSO’s Constitutional Law and Intergovernmental Relations Practice Group. In this role, Jon acted on behalf of the Attorney-General for Victoria in such significant constitutional matters as Kirk v Industrial Relations Commission (NSW), Unions NSW v New South Wales, McCloy v New South Wales and Bell Group NV v Western Australia. He also acted on behalf of Victorian and interstate government bodies in a range of tort,

Between 2004 and 2008, Jon worked as a solicitor in private practice and with the Transport Accident Commission. As a result, he has extensive experience acting for and advising plaintiffs, statutory insurers and corporations in relation to proceedings under the Transport Accident Act 1986 (Vic) and workers' compensation legislation.
