Trevor McLean has acquired extensive expertise as a result of a relatively long practice in civil, commercial and equity law at a trial and advisory level.
Trevor has considerable experience in Confiscation Act litigation. In particular he acted for the DPP in many confiscation matters in the County and Supreme Courts in relation to the Mokbel family and their associates.
For many years he practised in the insolvency laws jurisdictions for and against Liquidators and Trustees in Bankruptcy. In particular he conducted many compulsory examinations on behalf of Liquidators and Trustees in Bankruptcy and he acted in a variety of matters brought under the Corporations Act and the Bankruptcy Act.
Today the prime, but not sole, focus of his practice, which has varied over time, is on probate and wills, testator’s family maintanence and elder law.
But he has considerable experience in a broad range of commercial disputes, contract, consumer law ( misleading and deceptive conduct by individuals and corporations ), bankruptcy and corporate insolvency, director’s duties, public examinations of directors and bankrupts, confiscation of assets by the Cth and the State of Victoria, superannuation complaints, professional negligence, torts (including environmental related torts ), insurance and defamation.
Trevor favours, and is skilled at achieving, a practical, cost effective and tactically astute approach to the resolution of problems.
He is also an experienced mediator.
