Profile

Trevor Wallwork practices principally in criminal and public law.  He is experienced in criminal law, administrative law, town planning & local government law, tribunals, inquests & commissions of enquiry.  He regualrly appears in complex indictable criminal trials.

In 2016 he was awarded an Indictable Crime Certificate (ICC). The ICC certifies that Trevor has attained an appropriate level of competence as a barrister in the conduct of indictable criminal law matters.

Trevor has experience in Human Rights and Charter matters and in Freedom of Information, Discrimination and Equal Opportunity Act proceedings.

Trevor has significant experience in statutory regulation, including the Food Act, the Water Act, the Catchment & Land Protection Act and the Public Health & Wellbeing Act.

He has been briefed to appear on behalf of, and opposed to, various government and administrative entities, including Municipal Councils, the Department of Economic Development, the TAC, Goulburn-Murray Water, the Directors of Public Prosecutions (State & Cth), and the Director of Police Integrity.  He has advised on, and appeared in applications arising from the issue of subpoena (privilege, public interest immunity etc) in various jurisdictions. Trevor has also appeared at Tribunals and Examinations briefed by the Victorian Government Solicitor.  He has expertise in local government matters (planning, regulation, enforcement, & prosecution) in all jurisdictions.

Trevor is regularly briefed to appear in the Magistrates’, Coroner's, County and Supreme Courts; the Court of Appeal, and at VCAT.

Trevor accepts direct briefs and is regularly briefed by in-house and corporate counsel.

Trevor is an Australian Advocacy Institute Advocacy Instructor, and has taught in the Bar Readers' Course since 2010.  He has also taught advocacy at the Legal Training Institute (PNG) (2015 - 2017), and in the Solomon Islands (2017).

In March 2015, Trevor Chaired the Legalwise seminar "Practical Applications of Administrative Law" together with Stephen Donoghue QC.  Speakers included Peter Hanks QC and Graeme Hill of Counsel.

Trevor read with David Beach S.C. (now Justice Beach), and signed the Bar Roll in 2001.

Trevor has been led by senior members of counsel including Robert Richter QC, Richard Niall SC, Tim Margetts SC, Chris Ryan SC, John McArdle QC, & Bill Morgan-Payler QC.

Trevor holds a Cycling Australia Elite race licence and is a workplace coordinator for Bicycle Network's annual Ride to Work day.

Trevor accepts pro bono briefs through Justice Connect and the Asylum Seeker Resource Centre; and has provided assistance to the Environmental Defenders Office (NSW).

In 2018, Trevor appeared pro bono on behalf of the traditional landowners of Wagina (Solomon Islands) to successfully challenge the establishment of a bauxite mine. He was subsequently nominated for a Victorian Bar pro bono award for that work.

Trevor has recently appeared in the following significant matters:

  • Victorian Electoral Commission v Metropolitan Electoral Tribunal & Anor (2017) - Supreme Court judical review.
  • Police v DC (2016) - Magistrates Court and County Court sexual offences prosecution - successful dismissal of all charges as an abuse of process.
  • Brittain v Mansour (2013) - Supreme Court judicial review of imposition of monetary penalties as a condition of adjourned undertakings (bonds) by Magistrates.
  • Salter & Ors v City of Melb & Anor (2012 - 2014) - Building Appeals Board, Supreme Court & Court of Appeal proceedings in relation to classification of 'serviced apartments' under the Building Code / National Construction Code.
  • Police v K (2012-2013) - Historical sexual offences committal - all charges dismissed & discontinued.
  • Inquest into the death of Carolyn Rawlins (2009 - 2010) - briefed by The City of Melbourne.
  • R v Ashby
(2009 - 2010) - Supreme Court perjury trial.R v Hugo Rich (2007 - 2008) - Murder committalPolice v Kohuni & 6 ors (2006) – Murder committalR v Eaton; R v McCartney (2006) – Court of Appeal.R v McCulloch & Cotter (2005) - County Court drug trial.R v Federico (2005) – Supreme Court murder trial.

  • He has also been engaged as a sessional tutor in the Deakin University witness examination program; and is a former Chairman of the Flemington and Kensington Community Legal Centre.
