The New Tort of Serious Invasion of Privacy

In this brand new season, List members Marcus Hoyne and Liz Main discuss the new Privacy and Other Legislation Amendment Bill 2024, exploring existing rights to privacy in caselaw and how the introduction of the new tort could significantly impact the right to privacy. 

Marcus Hoyne specialises in media and defamation law and has more than 25 years’ experience in commercial litigation at both trial and appellate level. Although based in Melbourne, he is also a member of the New South Wales Bar and practices there.  

Liz Main has broad experience in common law and commercial law. Her experience traverses the full range of common law proceedings, including institutional abuse, police torts, intentional torts, negligence, WorkCover and TAC matters, with familiarity in jury trials, causes, serious injury applications and interlocutory disputes.
