In practice the only contract approved by the Legal Services Board or a professional association is the Contract of Sale of Real Estate co-published by the LIV and the Real Estate Institute of Victoria (the “standard contract”), the latest edition being published in September 2014.
Both the statutory and the standard contracts interact with the statement under s.32 of the Sale of Land Act 1962 (formerly called a “Vendor's Statement” and now called a “section 32 statement”) which in fact contained some of the contractual terms until it was removed in 2014. Accordingly this topic also takes in changes to this statement effected by the Sale of Land Amendment Act 2014.
