Dealing with Licensed Trustee Companies and Chapter 5D of the Corporations Act (2001)

In May 2010 the Corporations Act was amended to insert Chapter 5D. This chapter created a national regulatory regime for the trustee company industry. However,   there are still important state provisions that empower licensed trustee companies to ply their trade. This paper considers only those aspects of the operations of licensed trustee companies that are relevant for practitioners operating in the areas of elder law and succession law, the “traditional trustee company services".
