The insertion of Division 12A into the Family Law Act 1975 (Cth) (“the FLA”) brought with it a whole new regime of case management and trial process that amongst other things focused attention on the best interest of children from the outset both in terms of outcome of the proceedings and the conduct of the proceedings themselves.
