When is a laneway a public highway?

Description:

This paper considers a decision of the Supreme Court of Victoria wherein the Court considers the legal status of a laneway. The laneway ran between two dwellings from a residential street to a pathway adjacent a railway line. The Court considered the inter-relationship between the Local Government Act, the Road Management Act and the common law.
