In claims for damages arising from personal injury, pleadings are often generic. In many matters, this will not present any practical problem. However, care should be taken in claims brought against the State of Victoria, both by practitioners drafting allegations on behalf of a plaintiff and by those preparing the response, writes Romesh Kumar.
