Parenting cases where a client proposes to live with the children at an address a long way away from the other parent are notoriously difficult. There are no special rules to guide practitioners. The Full Court regularly reminds the profession that relocation cases are ‘just‘ parenting cases and the task is assessing competing proposals to make orders in the best interests of the child or children. Emma Swart looks at three recent appeal cases.
