On 22 July, 2013 the Fair Work Commission finalised its Practice Note 2/2013 on the topic of Fair Hearings. This Practice Note outlines a number of key points relating to the representation of parties by lawyers and paid agents. It also imposes a new obligation on parties seeking representation in appeal hearings to identify in writing the reasons why permission should be granted having regard to the matters outlined in s 596(2) of the Fair Work Act 2009 (Cth). A similar procedure will apply to parties seeking representation in unfair dismissal claims at first instance.
