A practical issue that often faces soliciitors is obtaining instructions from clients for Wills when their capacity is in doubt. This paper covers two sitations: a) when the testator is near death ans wishes to make a will and b) when a testator in their twilight years may seem competent but, in reality, has a tenuous grip on their capacity.
